1. THE ACTIVITY
I have booked a surf lesson, course or session with the School ("the Activity"). The Activity takes place in the sea, at beaches chosen by the School on the day according to conditions, and may include walking to and from the water, carrying equipment, and practice on the sand.

2. RISKS I UNDERSTAND AND ACCEPT
I understand that surfing is a physical, outdoor activity in a natural environment and carries risks that cannot be removed completely, even with careful instruction and supervision. These include, but are not limited to:
- drowning or near drowning;
- being hit by waves, by my own board or fins, or by other surfers and their equipment;
- currents, rip currents and changing tides;
- contact with sand banks, rocks or reef;
- marine life such as jellyfish, weever fish or stingrays;
- sunburn, heat, cold and hypothermia;
- sudden changes in weather and sea conditions;
- strains, sprains, cuts, fractures and other injuries.
I take part voluntarily and accept these inherent risks.

3. MY HEALTH AND SWIMMING ABILITY
I confirm that:
- I can swim at least [50] metres unaided and am comfortable in open water; [edit to your school's minimum]
- I have told the School in writing below about any medical condition, injury, pregnancy, allergy or medication that could affect my safety in the water;
- I will not take part under the influence of alcohol or drugs;
- I will tell my instructor straight away if I feel unwell or my health changes.
Medical conditions / medication / allergies: ____________________________

4. INSTRUCTIONS AND SAFETY
I agree to follow my instructor's directions at all times, to stay within the area the instructor sets, and to learn and use the safety signals explained at the start of the lesson. I understand the School may change the beach or time, shorten the Activity, or remove me from the water if it reasonably believes this is needed for my safety or the safety of others.

5. EQUIPMENT
I will use the boards, wetsuits and other equipment provided as instructed and report any damage or fault. [Optional: I may be asked to pay for loss of, or damage to, equipment caused by misuse or negligence on my part, as set out in the School's booking terms.]

6. FIRST AID AND EMERGENCY TREATMENT
I consent to first aid being given by School staff and, if needed, to the School calling the emergency services and arranging medical treatment on my behalf. [Edit to reflect who pays any treatment or transport costs in your country.]

7. RELEASE AND LIMITATION OF LIABILITY
To the fullest extent permitted by the law that applies to this agreement, I agree that the School, its owners, staff and instructors are not liable for injury, loss or damage that results from the inherent risks of surfing described in section 2.
Nothing in this agreement excludes or limits the School's liability for death or personal injury caused by its negligence, for fraud, or for any other liability that cannot be excluded or limited by law. My statutory rights as a consumer are not affected.

8. PHOTOS AND VIDEO (OPTIONAL)
[ ] I agree that the School may take photos or video of me during the Activity and use them on its website and social media. I can withdraw this consent at any time by contacting the School.

What a surf lesson waiver is for

People call it a waiver, but a good surf school form does more than ask a customer to give up their rights. It records four things you need for every person who goes in the water with you:

  1. Informed consent. The participant has been told, in plain language, what the real risks of a surf lesson are and accepts them.
  2. A health and swimming declaration. You know about the asthma, the recent shoulder injury or the weak swimmer before the lesson, not after.
  3. Agreement to your safety rules. They agree to follow the instructor, stay in the area and accept that you can change the beach or end the session.
  4. Contacts and consent. An emergency contact, consent to first aid, and an opt-in for photos.

The release of liability is usually the weakest part legally and the part schools rely on most. In many places a business cannot exclude liability for injury caused by its own negligence. In others the wording has to meet specific rules. The template is written with that in mind: it covers the inherent risks of surfing and leaves liability that the law doesn't allow you to exclude in place.

How to adapt the template for your school

  • Fill in every placeholder in square brackets: your legal name, address, registration number, privacy policy and booking terms links, and how long you keep records.
  • Set your swimming minimum. The template says 50 metres. Change it to whatever your school actually requires, and don't promise checks you don't do.
  • Match the risks to your beaches. Add the hazards that are real where you teach (reef, rocks, strong rips, cold water) and remove ones that aren't.
  • Check medical and treatment costs. Who pays for an ambulance or a clinic visit differs a lot between countries.
  • Ask your insurer. Many insurers require specific wording or a minimum set of declarations. Their wording wins over ours.
  • Have a local lawyer review it. This is the step that turns a template into a document you can rely on.

Paper or digital?

A clipboard on the beach works until it rains, the group arrives late, or you need to find one form from three summers ago. Digital waivers are easier to keep complete. Each participant signs before they arrive, the record is stored with a timestamp, and you can see who is missing before the lesson starts instead of chasing signatures at the water's edge. Our post on sending digital waivers automatically walks through the process step by step.

A waiver covers risk, health and consent. Money and dates belong in a separate policy: see our surf school cancellation and weather policy template.

Using this template in SurfSlot

If you take bookings with SurfSlot, you can use your reviewed version of this template as your school's waiver:

  1. In the dashboard, open Waiver settings, give the waiver a title and paste in your waiver text.
  2. Add custom fields for the information you want in its own field, for example medical conditions, swimming ability or emergency contact.
  3. When a customer books, every participant gets their own waiver link by email, not one per booking.
  4. If a participant is under 18, the form asks for the parent or guardian's name and signature instead.
  5. Unsigned waivers get an automatic reminder before the lesson, and the dashboard shows who has signed and who hasn't.

Each signature is stored with a timestamp, so you can find any participant's waiver later. Read more on the digital waivers page, or see how waivers fit into lesson safety.

Frequently asked

Is this surf school waiver template legally binding?

Not on its own. It is a starting point written in plain English. Whether a waiver is enforceable, and how far you can limit liability, depends on the law where you operate. Have a local lawyer review and adapt it, and check what your insurer requires.

Can a waiver protect my surf school if an instructor is negligent?

Often not. In many countries, including the UK and across the EU, a business cannot exclude liability for death or personal injury caused by its negligence, and consumer law limits what else you can exclude. Other countries, Australia among them, have their own specific rules for recreational activities. That is why the template keeps that liability in place and focuses on informed consent, health declarations and safety rules.

Do children need a separate waiver?

Under-18s should be signed for by a parent or legal guardian. The template has a guardian section. In SurfSlot, ticking that the participant is under 18 switches the form to guardian name and signature fields.

Should every person in a group sign, or just the person who booked?

Every participant should sign their own waiver, with their own health details and emergency contact. One signature for a family of four leaves three people with no declaration. SurfSlot sends a separate waiver link to each participant.

Can I translate the template?

Yes, and if most of your customers don't speak English, you probably should. Get the translation checked by your lawyer too, so the versions match.

How long should I keep signed waivers?

Ask your lawyer and insurer. The right period depends on how long someone can bring a claim in your country, which is often several years and can be longer for children.
